The products marketed and sold via the Website are sold and invoiced by Mikuta Fashion GmbH, a company organized under the laws of Germany, with registration number HRB 211065, VAT number DE326772598, and having its registered address at Paul-Lincke-Ufer 42, 10999 Berlin ("MIKUTA", "we", "us", "our").
1. Ordering of products
a) MIKUTA sells the products displayed on the website at the time when each order is submitted by a Client.
b) Products can be ordered by completing the checkout process. Once completed, an automatic confirmation email will be sent to acknowledge receipt of the order.
c) After reviewing the order, we will send a formal Order Confirmation detailing the products ordered, quantities, unit prices, and shipping costs.
d) If you notice any incorrect data in the Order Confirmation, you must notify us without undue delay.
2. Price and payment
a) All prices shown on the Website are excluding VAT and other applicable sales taxes.
b) Orders are subject to a minimum order value of 1.500€.
c) Shipping costs are charged to the customer and will be reflected in the invoice.
d) Payment terms are as follows:
- 60% of the order is due 30 days after arrival,
- The remaining 40% is due 60 days after arrival.
3. Deliveries
a) Products will be delivered to the address provided during checkout.
b) Upon receipt the order, the customer is responsible for verifying:
That the number and description of products match the delivery note.
That the packaging is intact, undamaged, and not visibly wet or altered.
c) Any issues (damage, missing items, discrepancies) must be:
Reported in writing to MIKUTA without delay.
Noted on the delivery receipt returned to the delivery company.
4. Returns
a) All wholesale orders are final, we do not accept returns.
5. Defective products
a) Orders are subject to mandatory consumer protection laws. In cases of defective products, you may be entitled to: repair, replacement, refund or price reduction or termination of the purchase agreement (depending on circumstances).
b) To facilitate investigation, we may request: a written description of the defect and/or evidence (photo/video)
c) If products need to be returned:
MIKUTA will provide a prepaid return label.
If you choose not to use the prepaid label, contact retailoperations@mikuta.com for return instructions (at your own cost).
If the defect is confirmed, we will reimburse any reasonable return shipping costs.
d) We are not liable to repair, replace, or refund any product that:
Has been misused, abused, neglected, or improperly cared for.
Was damaged due to alteration, accident, or unauthorized repair.
Was used in contradiction to instructions.
Has deteriorated due to normal wear and tear.
e) If the product is found to be non-defective, we may:
Decline to repair/replace/refund.
Charge the delivery and inspection costs to the original payment method.
To the extent permitted by law, we are not liable for any losses, damages, costs, or expenses related to improper return requests.
6. Personal data
a) You confirm you have received information on how we process your personal data, available in our [Privacy Policy].
b) If you provide personal data of third parties, you confirm that such individuals have been informed and, where applicable, consented to our data processing practices in accordance with applicable laws.
